The appellate court found that the trial magistrate erred in holding the appellant 100% liable in the absence of independent evidence and in light of conflicting accounts of the accident. The court held that liability should be apportioned equally between the parties at 50% each. On damages, the appellate court determined that the trial court relied on irrelevant authorities and awarded an excessive sum for general damages. Upon reassessment, the appellate court set general damages at Kshs.400,000/-, future medical expenses at Kshs.400,000/-, and special damages at Kshs.23,129/-, all subject to the 50% apportionment of liability. The respondent was awarded costs of the suit.
