RULING
1. I have considered the matter noted that when receiving submissions this court was not properly constituted a reason that will render this court’s judgment irregular.
Consequently, in the interest of justice I will vacate my earlier order, set aside the proceedings of 3rd October 2019 to allow the court proceed with this appeal in line with the requirement of Section 65 of the Civil Procedure Act.
2. The Deputy Registrar Family Division is tasked to prepare 2 more files and invite two Kadhis to seat at the hearing of this appeal on the 15th of January, 2020.
