The three-month delay was not inordinate given the circumstances, and the applicant satisfactorily explained the reasons for the delay. The court further determined that the intended appeal was not frivolous or an abuse of process, and thus exercised its discretion under section 79G of the Civil Procedure Act to grant leave to appeal out of time, subject to the applicant filing and serving the memorandum of appeal within 30 days.
