Environment and Land Case / Interlocutory Application Ruling
Legal Issues
- 1 Whether the status quo on the suit land should be maintained pending the hearing and determination of the suit.
- 2 Whether either party should be restrained from interfering with the suit land until the matter is heard and determined.
Ratio Decidendi
The court adopted the consent of the parties to compromise the interlocutory application, holding that the status quo on the suit land must be maintained. The defendant is restrained from disposing of or developing the land, while the plaintiff is restrained from entering the land, both pending the hearing and determination of the suit. The court further directed compliance with pretrial procedures under Order 11 of the Civil Procedure Rules, 2010, and set a date for pretrial directions. The orders ensure preservation of the subject matter and procedural compliance until the substantive dispute is resolved.
Court Disposition
Application compromised by consent; status quo orders issued.
Orders
- The status quo obtaining on the land be maintained; the defendant shall not dispose of the land or put up structures including a house on the land pending hearing and determination of the suit.
- The plaintiff shall not enter the suit land until the hearing and determination of the suit.
