The Environment and Land Court held that it could not transfer the Tigania suit because the Magistrate's Court could only transfer matters it was competent to hear in the first instance. Since the applicant's challenge to jurisdiction had already been dismissed by the Tigania court, and no appeal or review had been filed against that ruling, the same issue could not be relitigated in the ELC. The court found that the applicant's actions amounted to forum shopping and an abuse of process, as he only approached the ELC after an adverse contempt ruling. Consequently, the application for transfer and stay was dismissed as unmerited.
