Ratio Decidendi

The conviction was quashed because the charge was not supported by the evidence presented at trial. There was a material contradiction between the number of rolls of cannabis allegedly recovered (44 rolls according to police witnesses) and the number examined by the government analyst (10 rolls). Furthermore, the prosecution failed to produce the required sample, analyst's certificate, or magistrate's certificate as evidence of the nature and quantity of the drugs and their destruction, contrary to the mandatory procedure under Section 74A of the Narcotic Drugs and Psychotropic Substances Control Act. These defects rendered the charge unsustainable and the conviction unsafe.
