The trial magistrate erred in denying the appellant the right to recall and cross-examine key prosecution witnesses, which was a violation of the appellant's constitutional right to a fair trial under Article 50(2) of the Constitution. The denial was prejudicial to the appellant's defence, rendering the trial a mistrial. Considering the difficulty and prejudice of ordering a retrial, including the elapsed time, the redeployment of police witnesses, and the portion of sentence already served by the appellant, the interests of justice would not be served by a retrial.
