The tribunal found that the landlord had discharged the burden of proof by providing a sworn affidavit, a rent account statement, and a rent book demonstrating that the tenant owed Kshs 1,504,700 in arrears as at August 2024. The tenant failed to provide any receipts or documentary evidence to support his claim of overpayment or to contradict the landlord's figures. The tribunal held that mere assertions without proof do not meet the threshold set by Section 107 of the Evidence Act. Consequently, the landlord was entitled to levy distress for rent, and the tenant's objections were dismissed for lack of evidentiary support. Costs were awarded to the landlord as the successful party.
