The court found that, at the time the suit was filed, the applicants were resident within Vihiga District, and the respondent was entitled to institute proceedings at the Senior Resident Magistrate’s Court, Vihiga. The court held that trees are immovable property, and thus, under Section 12 of the Civil Procedure Act, the suit could be filed either where the property is situated or where the defendants reside. However, considering the convenience of the parties and their witnesses, and the fact that the cause of action arose closer to Kapsabet, the court determined that the ends of justice would be better served by transferring the suit to the Principal Magistrate’s Court, Kapsabet.
