Ratio Decidendi

The court found that although there was a period of inactivity exceeding one year since the last step taken by the parties, the delay was not inordinate or unreasonable. The respondent provided a satisfactory and excusable reason for the delay, namely her ill health and financial constraints. Applying the test from Ivita v Kyumbu, the court exercised its discretion not to dismiss the suit, holding that justice could still be done to both parties. Instead, the court ordered the transfer of the suit to the Thika Chief Magistrates' Court for hearing on a priority basis.
