The court found that the plaintiff proved special damages for funeral and police abstract expenses. As there was no evidence of the deceased's income from his clinic, the court used his last salary as a clinical officer as the basis for calculating loss of dependency. Applying a multiplier of 10 years and a dependency ratio of 2/3, the court awarded Kshs 501,200 as general damages for loss of dependency and Kshs 10,100 as special damages.
