Stay Application / Ruling on Application for Stay of Proceedings Pending Appeal

  1. 1 Whether there is sufficient cause to grant a stay of proceedings pending appeal.
  2. 2 Whether the defendant will suffer substantial injustice if the proceedings are not stayed.
  3. 3 Whether the appeal raises substantial and arguable grounds.

Ratio Decidendi

The court found that while the defendant had a right of appeal and the appeal raised substantial and arguable grounds, the main consideration in applications for stay of proceedings is one of convenience and whether sufficient cause has been shown. The court determined that no good cause had been demonstrated to warrant a stay of proceedings. It held that it was preferable for the main suit to proceed to hearing and determination, rather than being delayed pending the outcome of the appeal. The application for stay was therefore dismissed with costs to the plaintiff.
