Ratio Decidendi

The court found that the Respondent failed to comply with the mandatory requirements for redundancy under Section 40 of the Employment Act. The Claimants were notified of termination only by phone and text, with no evidence of proper notice or objective selection criteria. The Respondent admitted to withholding salary arrears and did not pay terminal dues. The redundancy process was therefore both procedurally and substantively unfair, entitling the Claimants to compensation, notice pay, salary arrears, and severance pay. The claim for house allowance was disallowed as the contracts provided for comprehensive salaries inclusive of house allowance.
