Order 42 Rule 6 of the Civil Procedure Rules is not directly applicable to succession matters as it is not imported by Rule 63(1) of the Probate and Administration Rules. However, the High Court's jurisdiction to grant a stay of execution in succession matters is preserved by section 47 of the Law of Succession Act and Rule 73 of the Probate and Administration Rules, which allow the court to make any orders necessary for the ends of justice.
