Although Order 42 Rule 6 of the Civil Procedure Rules is not expressly imported into succession proceedings by Rule 63(1) of the Probate and Administration Rules, the High Court retains jurisdiction to grant a stay of execution under section 47 of the Law of Succession Act and Rule 73 of the Probate and Administration Rules, which preserve the court's inherent powers. The court found that the applicant, having been in occupation of the property for over 50 years and facing potential eviction, would suffer hardship if evicted before the appeal is heard.
