Civil Cause / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the application for stay of execution pending appeal was properly brought before the court
  2. 2 Whether special circumstances exist to warrant a stay of execution pending appeal
  3. 3 Whether justice is better served by granting or refusing the stay

Ratio Decidendi

The application for stay was irregularly commenced but the court exercised its discretion to declare the step effectual for expediency. However, the 2nd defendant failed to demonstrate special circumstances or cogent evidence that restitution would be impossible if the appeal succeeded. The interests of justice are best served by refusing the stay but ordering that the executors of the deceased estate not transfer the property to third parties until the appeal is finalised.

Court Disposition

Application for stay pending appeal dismissed; interim stay vacated.

Orders

  • Executors of the deceased estate are ordered not to transfer the property to third parties until the appeal is finalised.
  • Each party to bear its own costs.
