Ratio Decidendi

The application for stay is dismissed because the High Court's ruling vacating the injunction is an inchoate decision not capable of appeal to the Supreme Court. The proper procedure was to make a fresh application for injunction, not to seek a stay of an unappealable order. Additionally, the Applicant remains in substantial debt, the vehicles are security for the entire debt, and there is no real prospect of success on appeal. Granting a stay would unjustly favour the defaulting Applicant and prejudice the Respondent.
