The application for stay of proceedings was dismissed because the assessment of damages is the logical process for the respondent to realise the fruits of litigation, and the appellant failed to demonstrate sufficient risk of injustice or inability of the respondent to repay damages if the appeal succeeds. The application was premature and misconceived as the assessment of damages was nearly complete and the proper remedy would be to seek stay of execution after damages are assessed.
