The sale of Kaka Motel was illegal, unlawful, and invalid as it was not conducted by a registered auctioneer, did not comply with statutory notice requirements, and was not by public auction as ordered. Kesale Auctioneers & Estate Agents lacked mandate due to non-registration. Mzuzu City Assembly could enforce rates only based on a pre-existing resolution by a lawfully constituted Assembly, but not otherwise. Immunity under section 91(8) does not cover illegal acts. The plaintiff remains liable for city rates as per the existing judgment.
