Procedural Posture

Civil Appeal / Application for Dismissal of Appeal for Want of Prosecution

  1. 1 Whether the appeal should be dismissed for want of prosecution due to delay in filing skeleton arguments and preparation of the record of appeal
  2. 2 Who bears responsibility for preparation of the record of appeal and prosecution of the appeal

Ratio Decidendi

The delay in filing skeleton arguments and preparation of the record of appeal, while inordinate, was not solely attributable to the appellant and did not amount to intentional or contumelious default. All parties, including the Registrar and the High Court, shared responsibility for the delay. There was no substantial prejudice or risk of unfair trial caused by the delay. Therefore, the application for dismissal for want of prosecution is dismissed.
