Ratio Decidendi

The Nissan truck is part of the deceased's estate and must be distributed according to the Wills and Inheritance Act. The 2nd appellant, as a dependant, is entitled to consideration, but the exclusion of the children of the first marriage was unfair. A fair distribution requires the 2nd appellant to pay half the truck's value to the respondent or else the truck be sold and proceeds divided equally.
