Ratio Decidendi

A candidate for the National Assembly need only be registered as a voter in any constituency, not necessarily the one in which he seeks nomination. Section 38(1)(c) of the Parliamentary and Presidential Elections Act, 1993, to the extent it requires registration in 'the' constituency, is inconsistent with Article 51(1)(c) of the Constitution and is invalid. The rejection of Mr. Chidule's nomination was therefore unlawful.
