Ratio Decidendi

The Supreme Court of Appeal found that, although the general rule is that an application for stay should first be determined by the court below, exceptions exist where justice so demands. In this case, the urgency and punitive nature of the orders below, the denial of leave to appeal, and the risk of irreparable harm justified the Supreme Court's intervention. The court exercised its discretion to sustain the stay of execution pending appeal, granted leave to appeal, and ordered the Applicants to take steps to prosecute the appeal. The court also found that Mr. Kadzipatike was sufficiently affected by the orders below to be a proper party.
