Detention of the appellants beyond the statutory custody time limits without lawful extension is unlawful. The lower court erred by failing to consider all mandatory statutory and guideline factors, including the expiry of custody time limits, the status of some appellants as minors, and the availability of sureties. The only lawful course after expiry of custody time limits is to release the accused, with discretion only as to whether release is with or without bail.
