Ratio Decidendi

Order 59 rule 13 of the Rules of Supreme Court is applicable in the Supreme Court of Appeal of Malawi for stay applications. The application for stay is not an appeal against refusal of stay by the High Court but a re-application, and thus does not require leave. The applicant has satisfied the requirements for a stay, as the appeal raises substantial issues and execution would render the appeal nugatory. Allegations of unclean hands are not sufficiently proved to deny the discretionary remedy.
