Ratio Decidendi

The Supreme Court of Appeal has concurrent jurisdiction to hear a stay application after refusal by the High Court under Order 59 rule 13 of the Rules of Supreme Court (1999 edition) as adapted to Malawi. The application for stay is not an appeal requiring leave but a re-application. The applicant's conduct did not amount to unclean hands on the evidence before the court. The appeal raises substantial issues, and execution before its determination would render the appeal nugatory. Therefore, a stay of execution and of the Warrant of Possession is granted pending appeal.
