Ratio Decidendi

The court held that the unattested draft will could not be relied upon to determine the deceased's intentions regarding administration. However, given the dispute between parties and the presence of minors, it was appropriate under section 42(4) of the Wills and Inheritance Act to appoint a neutral trust corporation, the National Bank of Malawi (Financial Management Services), as administrator. The order for each party to bear its own costs was upheld as a proper exercise of judicial discretion.
