The claimant, as a dependant, is entitled to damages for loss of dependency and funeral expenses under Part I of the Statute Law (Miscellaneous Provisions) Act. The court must assess damages by splitting pre-trial and post-trial loss, using minimum wage as the multiplicand in absence of proof of earnings, and discounting post-trial loss at the rate of Treasury Notes to reflect prudent investment in Malawi. The claim for loss of expectation of life is excluded as the claimant did not sue as executor or administrator of the estate.
