Procedural Posture

Election Petition / Judgment

  1. 1 Whether the alleged irregularities by the 1st Respondent resulted in neglect of its constitutional duties
  2. 2 Whether the alleged irregularities in the conduct of the 2nd Respondent gave the 2nd Respondent undue advantage in the final outcome of the polls

Ratio Decidendi

The Petitioner failed to prove, on a balance of probabilities, that the alleged irregularities by the 1st Respondent amounted to neglect of constitutional duties or that the irregularities in the conduct of the 2nd Respondent gave him undue advantage affecting the election result. While there was proven negligence in tallying at Emazwini polling station, the 136 unaccounted votes did not affect the overall result. The petition lacked merit as the allegations were not supported by evidence.
