Procedural Posture

Matrimonial Appeal / Judgment on Appeal

  1. 1 Whether the lower court erred in awarding the house to the Respondent without considering the Appellant's contribution
  2. 2 Whether the lower court erred in awarding the second and third motor vehicles to the Respondent without considering the Appellant's contribution
  3. 3 Whether the compensation awarded to the Appellant was just and adequate

Ratio Decidendi

The evidence established joint intention and contribution to the house, entitling the Appellant to one third of its value. The Respondent's greater contribution justified a two-thirds share. The Appellant's contribution to the vehicles was not sufficient to warrant co-ownership, and the lower court's award of the vehicles to the Respondent was upheld. The compensation awarded was inadequate given the duration and nature of the relationship; it was increased to K1,500,000.

Court Disposition

appeal partly allowed
