THE PROSECUTION v SIMBA ALOYS
Simba was found guilty of genocide and extermination as a crime against humanity for his participation in a joint criminal enterprise to kill Tutsi civilians at Murambi Technical School and Kaduha Parish, by distributing weapons and encouraging attackers, with intent to destroy a substantial part of the Tutsi group. The prosecution failed to prove beyond reasonable doubt his criminal responsibility for the massacres at Kibeho Parish, Cyanika Parish, and Ruhashya commune. The indictment and notice were found sufficient for the convictions. Aggravating factors included Simba's stature and the number of victims; mitigating factors were limited. The sentence imposed was 25 years' imprisonment.
