When parties to a contract containing an arbitration clause both proceed to litigate in court without invoking arbitration, they are deemed to have tacitly amended their agreement and waived the arbitration requirement. Consequently, neither party may later challenge the court's jurisdiction on this basis, and appeals on such grounds are inadmissible.
