Ratio Decidendi

The Supreme Court held that Mukamusoni failed to prove procedural irregularities in the judicial sale, as all required notifications and steps were followed. The sale price was not unreasonably low compared to prior transactions. The sale of Yansoneye's house was invalid as she had no right to sell after seizure, but the judicial sale remains valid. Mukamusoni is entitled to reimbursement for double payment of state fees and the surplus from the sale. Appeals by Yansoneye and Kamali were only partially upheld.

Court Disposition

Appeal partially allowed; judicial sale upheld; partial compensation awarded.
