MUKANKUBANA vs NIRAGIRE N’ABANDI
The Supreme Court found that the High Court judgment (RCA00263/2022/HC/KIG-RCA00269/2022/HC/KIG) was rendered in error by misidentifying the scope of land rights awarded to Mukankubana Bernadette in the earlier Abunzi and primary court decisions. The two judgments were irreconcilable and could not both stand. Applying the principle of res judicata, the Supreme Court set aside the later High Court judgment and upheld the earlier decision, restoring Mukankubana's rights.
