The Supreme Court held that the Court of Appeal erred by proceeding with the hearing after the respondent disowned his legal counsel without analyzing the grounds for disownment, thereby depriving him of his right to legal assistance. However, the Supreme Court found the second appeal inadmissible because the respondent had lost in both the Intermediate and High Courts on the same grounds, as required by article 28 of Organic Law no 03/2012/OL of 13/06/2012.
