BENEDETTA GROUP LTD v. RAB
Benedetta Group Ltd, although authorized to represent the joint venture in contract execution, lacked standing to sue in its own name for the entire debt owed to the joint venture. The right to sue for the joint venture's collective rights was not transferred to Benedetta Group Ltd, and the claim should have been brought by or on behalf of the joint venture as a whole. The lower court correctly dismissed the claim for lack of standing. Claims for costs and attorney fees were also denied as they were not properly substantiated or pleaded.
