The Labour Appeal Court held that section 143 of the Labour Relations Act creates a legal fiction whereby a certified CCMA arbitration award is treated as if it were an order of the Labour Court in respect of which a writ has been issued. This means that the certified award itself serves as the writ, and there is no need for the Labour Court or CCMA to issue a separate writ of execution. For monetary awards, enforcement proceeds as if the award were an order of the Magistrates' Court, allowing the Deputy-Sheriff to execute without further court intervention.
