The evidence presented consisted mainly of hearsay affidavits and statements, with no direct proof that the selected employees committed acts of violence or intimidation. The selection process was subjective and lacked sufficient evidentiary support. Consequently, the dismissals were both substantively and procedurally unfair. The Labour Court erred in refusing reinstatement, as there was no evidence linking the applicants to misconduct that would preclude the restoration of the employment relationship.
