The court held that the NDPP was justified in approaching the court ex parte for a restraint order under section 26(1) of POCA, as the statute expressly permits such applications and the circumstances did not warrant otherwise. The NDPP made adequate disclosure of all material facts, including prior proceedings and correspondence, and did not breach any agreement with the respondents. There were reasonable grounds to believe that a confiscation order may be made against the charged respondents, based on evidence of fraud, corruption, and money laundering involving the Trifecta Group and associated individuals.
