The Supreme Court of Appeal held that the full court was competent to inquire into costs occasioned by late settlement under its inherent powers and relevant practice directives. However, it was improper to order costs de boniis propriis against the CEO and Board in the absence of evidence of malice or bad faith, as required by section 15(3) of the Road Accident Fund Act. The Board was not joined to the proceedings and was not afforded an opportunity to be heard, rendering any costs order against it procedurally unfair.
