IN THE HIGH COUILT OF TiJZANIA

AT ARUSHA APPELIJ.TEJUISDICTICN HIGH COURT CRIIdIiTLT A FBIL M. 253 OF 1975 ORIGINAL CRIMINAL CASE NO, 1050 OF. 1974 OF THE DITIC? CORT Of ?T0STI BITRIC? JJ i'TOSHI BEFORE: MOMOJ. LUGUhU Esci. Resident Magistrate (Original Accused.) versus THE REPUBLIC ....,....... RESPONDENT (Original osccutor) • JUDGHBMT JONATHAI'T, J . The apioilant was convicted of cattle theft c/se •268 and 265 of the Penal Code. Ho w as sentenced to 5 years' imprisonment. The facts were brief. P.V .1 the complainant testified that on the relevant day at the TuNeri..i cattle auction he bought a cow for sh.350 and that he entrusted this animal to the appellant to drive it to hi $ shop at Lukaranga, this for reward. That seems to have bee 1 in the presence of P.W.3 and P.W.4 who in their evidence fully bore him out. He.did not however deliver that animal and he scone to have claimed it had got lost. The apel1ant vihen told of his right of defence replied h would say no ;h±ng and would call no evidence. The •conviction was LOfl returned. The facts in my L/. view wore insufficient for aiay onvic -bion. The appellant, as noted by no learned trial in Listrato, adopted a line of cross—exauining iJ.!C pros caution witnesses as would suggest he was denying the allegation 0: having been handed the cow. Such denial was obviously a lie arid it is not surprising he did not testify to reiterate .5th h stand.. The

prosecution had however to rrov its case. It had to prove not only that the cow was o.rrrased o the a a] 1 n.nt h,; ni nr thnh hc subsequently stole it. Now, facts are lacking from which to conclude that ho infect stole that cow. He ba.d told the complainant and P.1.2 th arresting and investigating police officer that the animal had tOt lost and accordingly, evidence should have been ledby the prosecution to refute this claim. In the c±rcueistancos should have ben h17. acquibcd. Aceoci rm coroncGlon is st aside and it is ordered the appol•an be IOrti7eJiiu released iron custody. The complainant may scol: redress by bringing a civil suit against nm.; Delivered in open court this 25th day of- August, 1977. (F. II. JONATHAN) PMJ/MT PIT. 31JDGE..
