05
Court’s reasoning
Legal principles
- 01
Judgment reasoning
Charges must be framed under the correct statutory provisions but misquoting subsections does not necessarily prejudice the accused if he knows the charges against him.
- 02
Judgment reasoning
Conviction should not be based solely on uncorroborated evidence of a witness whose credibility is questionable.
06
Ratio, limits and disposition
Ratio decidendi
The conviction was unsafe as it relied solely on the complainant's evidence, which was not corroborated and was contradicted by independent witnesses; the appellant knew the charges against him despite misquoted subsections, but the evidence did not support the convictions.
Obiter and limits
- Misquoting statutory subsections in charges is an irregularity but does not automatically prejudice the accused if the substance of the charge is clear.
- The complainant's denial of sending the appellant to buy kerosene is questionable given the evidence from independent witnesses.
Court disposition
appeal allowed
- convictions quashed
- sentences set aside
- appellant to be released immediately unless held on other lawful charges
- fine to be refunded if paid
