Procedural Posture

Criminal Appeal / Appeal From High Court to Court of Appeal

  1. 1 Whether the High Court order for the return of forfeited livestock to the respondents after quashing their convictions was proper and lawful
  2. 2 Whether the Government could lawfully dispose of the forfeited livestock without a court direction under section 351(4) of the Criminal Procedure Act

Ratio Decidendi

The High Court was correct in ordering the return of the forfeited livestock to the respondents because the forfeiture order was directly linked to their convictions, which were quashed. There was no legal basis or evidence to support the Government's claim that the livestock had already been lawfully sold, as no court direction for such sale existed. Both the Environmental Management Act and the Criminal Procedure Act require court direction for disposal of forfeited property, and upon quashing of conviction, the forfeiture order is discharged and property must be returned.

Court Disposition

appeal dismissed

Orders

  • Only 283 cows and 7 donkeys identified by the respondents are to be returned, distributed according to identification by each respondent.
