Ratio Decidendi

The Director of the British Council enjoys diplomatic immunity under Tanzanian law as the Council operates as an agency of the UK Government, and neither the Director nor the Council can be sued in Tanzanian courts unless immunity is waived. Order XXIX of the Civil Procedure Code does not apply to the British Council. The proceedings before the trial court were untenable at law and the suit is unsustainable.
