Procedural Posture

Criminal Appeal / Appeal Against High Court Order Denying Extension of Time

  1. 1 Whether the High Court properly exercised its discretion in denying extension of time to file notice of appeal and appeal
  2. 2 Whether the appellant demonstrated good cause for delay in filing appeal

Ratio Decidendi

The High Court erred by failing to consider that the appellant became aware of the judgment only upon being committed to prison and that, as a prisoner, he had no control over the filing process. The appellant filed the notice of appeal within ten days of becoming aware of the judgment and showed good cause for delay in filing the appeal. The High Court's refusal to grant extension was therefore unjustified.
