Ratio Decidendi

The Tanzania Railways Corporation Act, 1977 is not the exclusive machinery for settlement of employment disputes involving TRC employees. In the absence of an appeal to the Minister for Labour, the decision of the Conciliation Board under the Security of Employment Act, Cap. 574 is final and enforceable as a decree of the court. The subordinate court erred in dismissing the application on a preliminary objection; the decision and order of the trial court are set aside and the Kisutu Resident Magistrate's Court is ordered to enforce the Conciliation Board's decision as a decree of the court.
