Mr. Ngwembe insisted that the defP.ndant is not a corporr1tR body which can sue or be sued but t.h;=it_ it. is a govArnmRnt Department within the Ministry of Health in terms of s. 1(1) of the 8stahlishment Act, Act 3\93; that it.R operations arA dependent on the approval of the Minister (R.4(2)(r1) ;:inrl (1.) of the Act); that the OepRrt.ment's funoi,ng,r1mnng other::;, iR made 11p of funds voted for by the Parliament. Mr. Magesa, Advocate, for Plaintiff Also respon<le<l in writing but not without fuss. He bittery complained that one cannot start with an oral submissi.on And then embArk on written submissions and that this is an ahusP. of thP. court pror.P.ss. HR prayed that the submission should be st.ruck off. Jn the alternative, Mr. Magesa, argued that as the Attorney General has r.ome to t.he n.id of Oefendr1nt. thA issue is wl1P.thP.r· 0Af,=rncl;:rnl. is governm~nt Department or a government i.nstit11tion hence the argument that plaintiff was a governmAnt empJnyP.e iR irrelevant ... as the A-G has not come to Court in aid of plnintiff. Relying on Anh. A and B of the plaint Mr. MageRa inRiRted that i t was categorically stated that employees who wn11ld he taken over hy MSD would cease to be government employeeR and that therefore calling it (MSD) a government department i.s a contra<lir.tion in terms. In his further arguments, Mr. Magessa, observed that the Attorney General could come in to defend the MSD only if what was being challenged was the Minister's decision bt1t that this matter does not concern the Ministry of health.
