The appellant's termination was substantively and procedurally unfair as he was discriminated against for decisions made by the Tender Board, of which he was merely a member. Compensation for the unexpired term of the fixed contract was inappropriate; instead, section 40(1)(c) of the ELRA applied, entitling the appellant to compensation of eighteen months' remuneration.
