RESPONDENT RULING 19th July & 25th August 2022 Rwizile, J The application before me is for filing a representative suit. The applicants have filed this application praying this court to grant an application that a representative suit be filed. In the affidavit supporting their application, it has bee averred that when they first appeared before this court to file the application, it was struck out and on 2017. They then filed application No. 263 of 2017 which was struck out for being out of time. Thereafter, they filed many other applications but for one reason or another, they have not been successful. 5 Before, it came for a hearing, a preliminary objection was raised that the application is res judicata. I was asked to dismiss the application. The applicants, being represented by Mr. JJ. Kachenje learned counsel was asked to address the court on the same because the respondent, who was in the services of Mr. Shija Charles and MS. Mwantum Selle did not appear to prosecute the same. I did so because it touches the jurisdiction of this court. In his submission Mr. Kachenje admitted that on 21.09,2018, this court (Mruke,J) struck out, the application because it was time barred. In his view, since the same was struck out, the applicants had the chance to refile the same but subject to time limitation. According to him, this application was then filed. It is not, in his view a res judicata. The matter before me, it is my view, was therefore heard before this court and finally determined. Under Section 9 of the Civil Procedure Code, I am convinced, that the parties had litigated under the same title and so their application was finally determined. It is clear that a matter filed before the court out of time, when struck out or dismissed cannot be refiled again. It is finally determined. 6 In my view, it is therefore res-judicata. It cannot be litigated again. That being the case, the preliminary objection is sustained. The application is dismissed force with. Each party to bear its own costs. A.K. Rwizile JUDGE 25.08.2022 7
