The Federal Court dismissed judicial review of a Parole Board decision revoking Hayan Yassin’s statutory release, finding the revocation reasonable under Vavilov.
The appeal is dismissed because the Federal Court judge did not err: the Board had statutory jurisdiction to impose reasonable special conditions on the appellant’s full parole as he was serving a federal sentence under Criminal Code s.743.1 and Corrections and Conditional Release Act s.107(2); the Federal Court was not the proper forum to relitigate Quebec court judgments; and there was no statutory duty on the Attorney General of Canada to intervene in the provincial proceedings alleged by the appellant.
The motions judge erred by treating security and transportation costs as relevant factors under Rule 45; the proper test is whether it is in the interest of justice for the inmate to be physically present, judged by whether the inmate can adequately present his case if absent, considering specified factors, and the inmate bears the burden on a balance of probabilities to show physical presence is necessary.
